FAQ

When a person decides to start up a business, one of the first things he or she must do is decide which type of business structure to operate under. There are six major types of business organizations from which to choose. They are: sole proprietorship, general partnership, limited liability partnership, limited partnership, limited liability company & business corporation.

Which form the business owner chooses will depend upon a number of factors. Questions of liability, taxation, control, and the raising of capital are a few of the issues to be considered. Each form of business structure has advantages and disadvantages. The help of a legal professional is essential in evaluating all of the factors upon which the choice of business organization is based.
Closing costs are the fees for services, taxes or special interest charges that surround the purchase of a home. They include upfront loan points, title insurance, escrow or closing day charges, document fees, prepaid interest and property taxes.
Before starting up a business in China, you have to know what the options are. Foreign Investors generally establish a business presence in China in one of five ways: Wholly Foreign Owned Enterprise (WFOE), Partnership Enterprise (PE), Representative Office, Joint Venture and Hong Kong Company.
Classification under EB-1A is an attractive option, unlike most employment-based classifications, EB-1A petitions do not require an employer sponsor, and accordingly, the beneficiary may self-petition. The petitioner/beneficiary also need not be currently employed to petition for an EB-1A. Finally, an EB-1A is a desirable option because the petitioner can forego the labor shortage attestation process, which is usually required for lower-preference categories and can be a time-consuming process.

In New York State, the minimum requirements for a retail liquor license applicant are: U.S. citizen or permanent resident alien status; Age 21 or older; No felony convictions; Not a police officer with arresting powers.

Applications may be denied based on location. Your establishment cannot be within 200 feet of a church, school, synagogue or any other place of worship. Other reasons for denial include: Failure to disclose residential past; Failure to disclose criminal past; Failure to disclose source of funds; Incomplete or missing information.

After you have been issued your license, it is important to strictly obey the rules of the New York State Liquor Authority. Failure to adhere to their guidelines can lead to citations and possible revocation of your liquor license.
In some cases, foreclosure is the more efficient option. However, lenders lose money with every foreclosure and can be required to increase their reserves. The banks already have the liabilities of owning too many foreclosed properties and having too many non-performing loans on their books. In many cases, lenders would much rather modify your mortgage loan to something affordable and convert your loan into a performing asset, or otherwise resolve your troubled mortgage to reduce their losses. Your foreclosure defense attorney must convince your lender of this choice.
